1. Introduction
This End User Agreement (the “Agreement”) is made between you (the “User” or “You”) and Trusave Fintech Private Limited (hereinafter referred to as “Client”), a private limited company having its registered office at E-101, Sanmati Kunj, Dwarka Sector-6, New Delhi - 110075 (“CLIENT”, “Us” or “We”, which term shall include its successors and permitted assigns). The User and CLIENT shall be collectively referred to as the “Parties” and individually as a “Party”
I hereby consent to Bachatt being appointed as my authorised representative to receive my Credit Information from Experian or other similar credit bureaus for the purpose of advising me on best financial products and services until completion of the End Use Purpose or expiry of 6 months from the date the consent is collected; whichever is earlier.
BY EXECUTING THIS AGREEMENT / CONSENT FORM, YOU ARE EXPRESSLY AGREEING TO ACCESS THE EXPERIAN OR ANY OTHER SIMILAR CREDIT BUREAUS CREDIT INFORMATION REPORT AND CREDIT SCORE, AGGREGATE SCORES, INFERENCES, REFERENCES AND DETAILS (AS DEFINED BELOW)(TOGETHER REFERRED AS “CREDIT INFORMATION”). YOU HEREBY ALSO CONSENT TO SUCH CREDIT INFORMATION BEING PROVIDED BY EXPERIAN OR ANY OTHER SIMILAR CREDIT BUREAUS TO YOU AND CLIENT BY USING EXPERIAN OR ANY OTHER SIMILAR CREDIT BUREAUS TOOLS, ALGORITHMS AND DEVICES AND YOU HEREBY AGREE, ACKNOWLEDGE AND ACCEPT THE TERMS AND CONDITIONS SET FORTH HEREIN.
2. Services
Bachatt provides a platform for daily savings and investment in various financial products, including mutual funds, digital gold, fixed deposits, and other investment options as may be introduced from time to time.
We also offer additional financial services such as loans, credit cards, and insurance, in partnership with our affiliates and third-party service providers.
3. Eligibility
You must be at least 18 years old and a resident of India to use our Services.
By using our Services, you represent and warrant that you have the right, authority, and capacity to enter into these Terms and to abide by all applicable laws and regulations.
4. Information Security
CLIENT shall access your Credit Information as your authorized representative and CLIENT shall use the Credit Information for limited End Use Purpose consisting of and in relation to the services proposed to be availed by you from CLIENT. We shall not aggregate, retain, store, copy, reproduce, republish, upload, post, transmit, sell or rent the Credit Information to any other person and the same cannot be copied or reproduced other than as agreed herein and in furtherance to applicable law including the CICRA.
The Parties agree to protect and keep confidential the Credit Information both online and offline.
The Credit Information shared by you, or received on by us on your behalf shall be destroyed, purged, erased immediately upon the completion of the transaction/ End Use Purpose for which the Credit Information report was procured, this period not being longer than 6 months.
5. Account Registration
To access certain features of our Services, you may be required to register for an account.
You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
6. User Conduct
You agree not to:
- Use our Services for any illegal or unauthorized purpose.
- Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity.
- Interfere with or disrupt our Services or servers or networks connected to our Services.
- Use any data mining, robots, or similar data gathering or extraction methods.
- Violate any applicable laws or regulations.
7. Intellectual Property
The Platform, App, and Services, including all content, features, and functionality, are owned by Bachatt and are protected by copyright, trademark, and other intellectual property laws.
8. Disclaimer
Bachatt provides a platform for accessing financial products and services but does not provide any financial advice.
The information provided on our Platform and App is for informational purposes only and should not be construed as investment advice.
You are solely responsible for your investment decisions and should consult with a qualified financial advisor before making any investment decisions.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Bachatt shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the services; (ii) any conduct or content of any third party on the services; (iii) any content obtained from the services; or (iv) unauthorized access, use, or alteration of your transmissions or content.
10. Indemnification
You agree to indemnify and hold Bachatt harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.
11. Termination
Bachatt may terminate your access to all or any part of the Services at any time, with or without cause, with or without notice, effective immediately.
12. Governing Law and Dispute Resolution
The relationship between you and CLIENT shall be governed by laws of India and all claims or disputes arising there from shall be subject to the exclusive jurisdiction of the courts of Delhi.
13. Entire Agreement
These Terms constitute the entire agreement between you and Bachatt relating to the subject matter herein and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and Bachatt with respect to the Services.
14. Changes to Terms
Bachatt reserves the right to modify these Terms at any time in its sole discretion.
If we make material changes to these Terms, we will post the updated Terms on our Platform and update the "Last Updated" date at the top of this page.
Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes.
15. Definitions
Capitalised terms used herein but not defined above shall have the following meanings:
“Business Day” means a day (other than a public holiday) on which banks are open for general business in Mumbai.
“Credit Information Report” means the credit information / scores/ aggregates / variables / inferences or reports which shall be generated by Experian or other similar credit bureaus;
“Credit Score” means the score which shall be mentioned on the Credit Information Report which shall be computed by Experian or other similar credit bureaus.
“Credit Bureau” are agencies approved by RBI which collects customer credit history. These would include but not limited to Transunion CIBIL, Experian, Equifax and CRIF High Mark.
“CICRA” shall mean the Credit Information Companies (Regulation) Act, 2005 read with the Credit Information Companies Rules, 2006 and the Credit Information Companies Regulations, 2006, and shall include any other rules and regulations prescribed thereunder.
