1.1The domain name http://zetapp.in/ and the associated mobile application titled 'ZET', along with all upgrades, updates, enhancements and modifications thereto ("Domain"), is owned and managed by ZET Technolabs Private Limited, a company incorporated under the Companies Act, 2013, with its registered office at Olsen Spaces, 2nd Floor, HSR Layout Sector 6, 12th Main 14th Cross, Opp JSS Public School, Bengaluru – 560102 ("ZET", which includes its successors, affiliates and permitted assigns).
1.2ZET is committed to respecting your online privacy. This privacy policy ("Policy") explains how ZET will collect, use, share and process information in relation to the Services provided on the Domain.
1.3This Policy is deemed incorporated into the terms of use applicable to you ("Terms") and is read in addition to the Terms. In the event of any conflict between this Policy and the Terms, the interpretation placed by ZET shall be final and binding. Capitalized terms not defined here have the meaning ascribed in the Terms.
1.4By accepting this Policy through an affirmative action, you give free, specific, informed, unconditional and unambiguous consent to the collection, use, sharing and processing of personal information as described herein. If you provide information about someone else, you confirm that (a) it is accurate and up to date; (b) that person is aware you have provided it; and (c) they consent to its disclosure and use in accordance with this Policy. This Policy applies to all current and former visitors, users and others who access the Domain.
2.1This Policy is an electronic record under the Information Technology Act, 2000 and the rules thereunder, and does not require any physical, electronic or digital signature.
2.2By accessing or using the Domain, giving ZET your information, or clicking to accept this Policy, you undertake that you have the capacity to enter into a legally binding contract under applicable law, in particular the Indian Contract Act, 1872. ZET will collect and process your personal and third-party data carefully, only for the purposes described here and only to the extent necessary, within the scope of applicable legal regulations, and in a manner that is ethical, compliant and adheres to best industry practices.
2.3Please read this Policy carefully before accepting it and/or accessing the Domain. If you are accepting on behalf of another person, you warrant that you have full authority to bind them. If accepting on behalf of a child or person with disability, you warrant that you are their parent or legal guardian.
2.4This Policy describes the types of information ZET collects, why and how it uses the information, with whom it shares it, and the choices you can make, as well as the measures ZET takes to protect security and how to contact ZET about its privacy practices.
2.5This Policy describes ZET's current data protection practices and may be amended from time to time. ZET will notify you at least once a year, or whenever the Policy changes, by email or a conspicuous notice on the Domain. The updated Policy takes effect from the date of update. Your continued use of the Domain thereafter implies unconditional acceptance of the updates.
3.1By performing the affirmative action deemed fit by ZET, you expressly, freely, unconditionally and unambiguously consent to ZET's use and disclosure of your Personal Information and third-party information in accordance with this Policy. If you do not agree, please do not use the Domain.
3.2You appoint ZET Technolabs Private Limited (registered office as above) and its Partners as your lawful agent to receive your credit report/credit history ("Credit Information") from Credit Information Companies ("CICs") notified by the Reserve Bank of India, and to obtain your record from CKYCR.
3.3You authorize ZET and its Partners to share your personal details with CICs to procure your Credit Information at a frequency authorized under law, and to use it to offer financial products suited to your needs (the "Purpose").
3.4You acknowledge that the CIC shall not be liable for providing your Credit Information to ZET, and you will not raise any claim against the CIC. This consent is given by your free will and not due to any solicitation.
3.5This consent is valid for the earliest of: (i) a maximum period of six (6) months from the date given; (ii) satisfying the Purpose; or (iii) until you withdraw consent by informing ZET at its registered office, website, assigned email or mobile application. You also consent to the terms of use of CRIF High Mark, Experian PLC, Equifax Inc. and TransUnion CIBIL Limited, as amended from time to time.
4.1Personal Information is any information relating to a natural person which, directly or indirectly, in combination with other available information, is capable of identifying such person.
4.2Personal Information includes, without limitation, first and last names, telephone number, email address, photograph or other contact information, educational qualifications and work experience. Sensitive Personal Data or Information ("SPDI") includes information relating to passwords, financial information (bank accounts, credit/debit cards or other payment instruments) and physical information. ZET limits collection to what is necessary for the intended purpose, and expressly clarifies that it neither collects nor stores your biometric information.
4.3ZET may have one-time access to your camera, microphone, location and/or mobile device and store such information only for onboarding or KYC requirements of ZET and/or Partners, with your explicit consent, in accordance with RBI guidelines.
4.4Non-Personal Information does not specifically identify an individual but includes browser type, the URL of previously visited websites, ISP, operating system, IP address, and details such as how many people visit the Domain, pages visited, time zone settings and locations, applications installed, device ID/manufacturer/type, connection information, screen resolution and usage statistics — including de-identified Personal Information that is no longer identifiable to you.
4.5Usage Information is all data collected automatically through the Domain (or via third-party analytics), including system administrative data, statistical and demographic data, cookies, traffic, time spent, number of visits and similar behaviour indicating the manner of use of the Domain.
4.6Personal Information, SPDI, Non-Personal Information and Usage Information are together referred to as "Information".
5.1ZET may collect Information when you (a) access the Domain via a link shared by ZET; (b) fill any registration form; (c) use the Domain to avail Services; (d) provide any Information on the Domain; (e) participate in campaigns or respond to questionnaires; or (f) complete a survey or provide feedback.
5.2You acknowledge that all Information is provided voluntarily and is not subject to any undue influence.
5.3ZET may use cookies to monitor Domain usage, simplify your experience on return, remember your Information, and deliver relevant content based on your preferences, usage patterns and location.
5.4ZET may collect Non-Personal Information based on your browsing activity (IP address, operating system, prior search results, etc.).
5.5Information collected from a particular browser or device may be used with another linked computer or device.
5.6You may use the Domain without providing any Information about yourself, but you may not be able to access certain services if you choose to do so.
5.7ZET will collect information from your SMS upon you granting access rights for the same.
5.8ZET may request permission to send SMS from your device, solely to verify that the SIM card corresponds to the phone number used during your credit card or loan application — to ensure authenticity and prevent fraudulent applications. This permission is used only after obtaining your explicit consent.
6.1ZET uses the Information you provide to (a) fulfil your requests for Services; (b) provide relevant information/recommendations on financial products offered by Partners; (c) share it with Partners to facilitate your registration for the Partner's financial product; (d) inform you of available Services and offer other products/services that may interest you; and (e) manage ZET's relationship with you.
6.2ZET may monitor your use of the Services and analyse your Information to provide customized recommendations.
6.3ZET may use Non-Personal or Usage Information for internal business purposes such as data analysis, research, developing new products/features, improving services and identifying usage trends.
6.4Subject to applicable laws, ZET may use your Information for promotional/marketing activities, including using Personal Information for posters/banners to promote ZET Services.
6.5When you email or contact ZET, it may use your Information to respond via messages, SMS, email or other channels, and may archive it for future communications about updates, newsletters, offers, new services and promotions.
6.6ZET may access and read your SMS to monitor your use of the Services and analyse your messages to understand your requirements and provide customized recommendations.
7.1ZET maintains your Information in electronic form. It is made accessible to employees, agents, Partners and third parties only on a need-to-know basis.
7.2ZET shares your Information with third parties, including Partners and others engaged for providing Services to you, to the extent required.
7.3ZET does not rent, sell or share Information with non-affiliated entities, except with your consent, to provide requested Services, or under the following circumstances:
8.1In addition to Partners, ZET may engage other third-party vendors/contractors for support services (fulfilment of requests, software maintenance, advertising and marketing, web hosting, etc.). They may have limited access to Information only to perform those tasks and are not authorized to otherwise use or disclose it, except as required by law. ZET makes no representations about the privacy practices or terms of such websites, nor does it control or guarantee the content on them.
8.2The Domain may contain links to third-party websites. ZET is not responsible for their functionality, actions, privacy settings, policies, terms or content. Before using any sharing functions or visiting such websites, ZET strongly recommends you review their terms and privacy policies.
ZET may disclose and/or transfer Information to an investor, acquirer, assignee or other successor entity in connection with a sale, merger or reorganization of all or substantially all of ZET's equity, business or assets.
10.1You may withdraw your consent at any time by intimating ZET in writing via email at [email protected]. To rectify your Personal Information, write to ZET as per Section 11.
10.2Once you withdraw consent, ZET may choose not to fulfil the purposes for which the Personal Information was sought, and may restrict your use of the Services or the Domain.
10.3You may discontinue using the Services at any time per the Terms, by discontinuing use of the Domain or by writing to [email protected]. However, Partners who received your information during your use of the Domain may continue to retain it as they deem fit, and any deletion of information held by Partners is governed by the Partners' own privacy practices.
11.1Except for Information shared with Partners, you may review, modify, correct, erase or delete Personal Information you provided directly on the Domain. Such changes may affect your ability to use the Domain and ZET's ability to provide Services, and will not automatically modify Information already shared with Partners.
11.2ZET reserves the right to verify and authenticate your identity and Information. Access to, or correction/erasure/update/deletion of, your Personal Information and/or SPDI may be denied or limited if it would violate another person's rights or is not permitted by applicable law.
11.3To update, erase or correct your Personal Information, send your request to [email protected] citing the reason. ZET will make reasonable efforts to incorporate the changes within a reasonable period.
12.1ZET will store your Personal Information for at least such period as required and permitted by law, or as necessary to satisfy the purpose for which it was collected. These periods vary by the nature of the information and your interactions with ZET.
12.2ZET may store Non-Personal and Usage Information for as long as required, in accordance with applicable law.
12.3You agree not to submit false, illegal or damaging content. ZET reserves the right to terminate access in response to any such concerns, or for any other reason, at its sole discretion.
13.1ZET uses cookies and other tracking technologies to distinguish you from other users and remember your preferences. Cookies are text files placed on your device to store preferences; by themselves they do not reveal your email or other personally identifiable information unless you provide it (e.g., by registering). Cookies may also be placed by third parties, whose use ZET does not control.
13.2Session cookies are automatically deleted once a session ends. You may decline cookies, but you may then be unable to use certain features and may need to re-enter your password frequently.
14.1ZET has taken adequate measures to protect the security of Information and takes robust precautions to protect your data from loss, misuse, unauthorized access or disclosure, alteration or destruction.
14.2ZET uses industry standards and physical, technical and administrative security measures to keep Information confidential and secure. However, ZET cannot guarantee absolute security when Information is transmitted over the internet.
14.3ZET shall not be liable for any loss or theft of Information due to unauthorized access to your device or other reasons solely attributable to you, nor for any breach or third-party actions beyond its reasonable control (acts of government, hacking, unauthorized access, computer crashes, breach of security/encryption, poor internet/telephone service, etc.).
ZET does not intend to attract anyone under the relevant age of consent, or a person with disability, into binding legal contracts, and does not knowingly collect Personal Information from such persons. ZET encourages parents and guardians to be involved in the online activities of a minor or person with disability. If you use the Domain on behalf of someone else (including your minor child), you warrant that you are authorised to accept this Policy and give consent on their behalf. If accepting on behalf of a child or person with disability, you warrant that you are their parent or legal guardian.
16.1ZET shall not be liable for any loss of profit, production, anticipated savings, goodwill or business opportunities, or any direct or indirect, incidental, economic, compensatory, punitive, exemplary or consequential losses arising out of performance or non-performance of its obligations under this Policy.
16.2ZET is not responsible for any actions or inactions of third parties that receive your Information.
16.3ZET shall not be responsible for any loss, damage or misuse of your Information attributable to a Force Majeure Event — any event beyond ZET's reasonable control, including sabotage, fire, flood, explosion, acts of God, civil commotion, strikes, riots, war, acts of government, hacking, computer crashes, breach of security/encryption, pandemic or national/state lockdown, and similar events.
You may receive communication — messages on the Domain, SMS and phone calls from ZET and/or Partners on your registered mobile number, and emails on your registered address. You may 'opt-out' of newsletters and general marketing communications via the links at the bottom of each mailer, and ZET will take adequate steps to remove you from such lists. However, you cannot opt out of administrative messages, customer service responses or other transactional communications. ZET cannot guarantee opt-out from Partners' mailers — you must contact the relevant Partner directly.
ZET reserves the right to update, change or modify this Policy at any time. The Policy takes effect from the date of such update, change or modification.
This Policy is governed by and construed in accordance with the laws of India. The place of jurisdiction shall exclusively be Bangalore, Karnataka. Any dispute arising out of this Policy shall be settled by binding arbitration conducted by a sole arbitrator appointed jointly by both parties, governed by the Arbitration and Conciliation Act, 1996. The venue and seat of arbitration shall be Bangalore, Karnataka.
